Supervisor BRADT offered the following Resolution and moved its adoption:
RESOLUTION AUTHORIZING A USE AND OCCUPANCY PERMIT WITH NYSDOT FOR GATEWAY TO THE ADIRONDACKS VISITOR CENTER AND FJ & G RAIL TRAIL
WHEREAS, the “Gateway to the Adirondacks” Visitor Center building and FJ & G Rail Trail are on land owned by the State of New York; and
WHEREAS, Resolution 133 of 2018 authorized a Consolidated Use and Occupancy Permit with NYSDOT for Visitor Center, FJ & G Rail Trail and Vail Mills Sanitary Sewer System; and
WHEREAS, Resolution 278 of 2020 authorized transfer of certain Sewer System Infrastructure for Fulton County Sewer District No. 2: Vail Mills to the Village of Broadalbin; and
WHEREAS, a new Use and Occupancy Permit with NYSDOT is required to remove the Vail Mills Sanitary Sewer System infrastructure from Fulton County’s permit; and
WHEREAS, the Village of Broadalbin will enter into a Use and Occupancy Permit with NYSDOT for saidVail Mills Sanitary Sewer System infrastructure; now, therefore be it
RESOLVED, That the Chairman of the Board be and hereby is authorized to execute a Use and Occupancy Permit agreement with the NYS Department of Transportation for the Gateway to the Adirondacks Visitor Center land, FJ & G Rail Trail (Vail Mills) excluding the Vail Mills Sanitary Sewer System, effective at the mutual consent of both parties; and, be it further
RESOLVED, That said agreement is subject to the approval of the County Attorney; and, be it further
RESOLVED, That certified copies of this Resolution be forwarded to the County Treasurer, County Attorney, Planning Director, Superintendent of Highways and Facilities, NYS Department of Transportation, Fulton County Chamber of Commerce, Budget Director/County Auditor and Administrative Officer/Clerk of the Board.
